Today, February 5, 2026, the Parliament of the Republic of Moldova voted in two readings on the draft law on the accession of the Republic of Moldova to the European Patent Convention (EPC).

The legislative initiative aims to ensure the normative framework necessary for the accession of the Republic of Moldova to the European Patent Convention, adopted in Munich on October 5, 1973 and subsequently revised by the Act revising Article 63 of December 17, 1991 and the Revising Act of November 29, 2000. The Convention is the international treaty that establishes the single procedure for granting European patents by the European Patent Office (EPO), patents that benefit from protection in 39 Member States.

An important moment in the European path of the Republic of Moldova in the field of invention protection was the official invitation issued on December 13, 2022 by the Administrative Council of the EPO, by which the Republic of Moldova was invited to become a full member of the European Patent Organization. This strategic opportunity allows the alignment of the national invention protection system with the European standards and access to the benefits of the centralized patenting procedure.

By joining the EPC, the Republic of Moldova will obtain significant benefits for the innovation environment and economy, including:

• access of national inventors and applicants to a single, more efficient and less costly procedure;
• protection of inventions by a European patent – ​​a strong title with high legal and economic value;
• harmonization of national legislation with advanced European standards;
• participation of AGEPI in the governance structures and decision-making process of the EPO;
• technical and institutional cooperation with the EPO and other national offices, including training of specialists and access to databases;
• increasing the economic attractiveness of the Republic of Moldova by strengthening the innovation protection system, stimulating investments and technology transfer.

Currently, the normative framework necessary for the implementation of the Convention is provided by Law No 50/2008 on the Protection of Inventions, as amended by Law No 135/2025. The respective norms will enter into force on the date of acquiring the status of a Member State of the European Patent Convention.

It should be noted that the Republic of Moldova is already at an advanced stage of cooperation with the EPO. In 2013, the Agreement on Validation of European Patents was signed, ratified by Law No 57/2015 and applicable from 1 November 2015, which recognizes the effects of European patents on the territory of our country. Accession to the EPC is a natural continuation of this path.

This initiative marks an important step in strengthening the position of the Republic of Moldova in the European invention protection system and in supporting innovators and the national business environment.

Parlamentul Republicii Moldova a votat astăzi, 5 februarie 2026, în două lecturi proiectul de lege privind aderarea Republicii Moldova la Convenția privind eliberarea brevetelor europene (CBE).

Inițiativa legislativă vizează asigurarea cadrului normativ necesar aderării Republicii Moldova la Convenția privind eliberarea brevetelor europene, adoptată la München la 5 octombrie 1973 și revizuită ulterior prin Actul de revizuire a articolului 63 din 17 decembrie 1991 și Actul de revizuire din 29 noiembrie 2000. Convenția reprezintă tratatul internațional care instituie procedura unică de acordare a brevetelor europene de către Oficiul European de Brevete (OEB), brevete care beneficiază de protecție în 39 de state membre.

Un moment important în parcursul european al Republicii Moldova în domeniul protecției invențiilor a fost invitația oficială adresată la data de 13 decembrie 2022 de către Consiliul de Administrație al OEB, prin care Republica Moldova a fost invitată să devină membru cu drepturi depline al Organizației Europene de Brevete. Această oportunitate strategică permite alinierea sistemului național de protecție a invențiilor la standardele europene și accesul la beneficiile procedurii centralizate de brevetare.

Prin aderarea la CBE, Republica Moldova va obține beneficii semnificative pentru mediul de inovare și economie, printre care:

• accesul inventatorilor și solicitanților naționali la o procedură unică, mai eficientă și mai puțin costisitoare;
• protecția invențiilor prin brevet european – un titlu puternic, cu valoare juridică și economică ridicată;
• armonizarea legislației naționale cu standardele europene avansate;
• participarea AGEPI la structurile de guvernanță și procesul decizional al OEB;
• cooperare tehnică și instituțională cu OEB și cu alte oficii naționale, inclusiv formarea specialiștilor și acces la baze de date;
• creșterea atractivității economice a Republicii Moldova prin consolidarea sistemului de protecție a inovației, stimulând investițiile și transferul de tehnologie.

În prezent, cadrul normativ necesar implementării Convenției este asigurat prin Legea nr. 50/2008 privind protecția invențiilor, astfel cum a fost modificată prin Legea nr. 135/2025. Normele respective vor intra în vigoare la data dobândirii calității de stat membru al Convenției brevetului european.

De menționat că Republica Moldova se află deja într-o etapă avansată de cooperare cu OEB. În anul 2013 a fost semnat Acordul privind validarea brevetelor europene, ratificat prin Legea nr. 57/2015 și aplicabil din 1 noiembrie 2015, prin care sunt recunoscute efectele brevetelor europene pe teritoriul țării noastre. Aderarea la CBE reprezintă continuarea firească a acestui parcurs.

Această inițiativă marchează un pas important în consolidarea poziției Republicii Moldova în sistemul european de protecție a invențiilor și în susținerea inovatorilor și mediului de afaceri național.
