WIPO Member States Discussed About Protection of Trademarks, Industrial Design and Geographical Indications


The 43rd Session of the Standing Committee of the World Intellectual Property Organization (WIPO) on the Law of Trademarks, Industrial Designs and Geographical Indications (SCT/43) was held in Geneva, Switzerland, from November 23 to 26, 2020. The meetings took place in a mixed regime (with room presence and online participation).

According to the Agenda, during the current session of the SCT Committee were discussed several topics related to:

  • Protection of the Design of Graphical User Interfaces (GUI);
  • Temporary Protection Provided to Industrial Designs at Certain International Exhibitions;
  • Resolving Conflicts between Trademarks and Domain Names (DNS);
  • Protection of Country Names and Geographical Names of National Significance, including in the domain name system (DNS);
  • Protection of Geographical Indications.

 The SCT/43 Committee was attended by more than 160 representatives from WIPO Member States, international governmental and non-governmental organizations.

The AGEPI delegation was composed of Simion Levitchi, Head of Trademarks and Industrial Design Department, and Alexandru Saitan, Head of Industrial Designs Division. Agency representatives participated in meetings online.

The SCT/43 Committee meeting was opened by Daren Tang, Director General of the World Intellectual Property Organization, who mentioned the importance of the current meeting of the Committee to discuss the topics on the Agenda. He noted that there has been a growing interest in the protection of industrial designs, including the protection of graphical user interfaces (GUIs) in the context of IT development. He also stressed that given the current situation it was not possible to discuss the Convening of a Diplomatic Conference of the Design Law Treaty (DLT) at the WIPO General Assembly in 2020. This issue is a priority for WIPO. Regarding trademark protection, he mentioned that, according to the Agenda, the topics related to the protection of country brands in the Member States, the protection of country names and geographical names of national significance will be addressed.

Under SCT 43, an Information Session on Temporary Protection of Industrial Designs was organized at certain international exhibitions. During the Session, 5 communications were presented, which can be accessed at: https://www.wipo.int/meetings/en/details.jsp?meeting_id=55587.

The practice of the Republic of Moldova was presented by Simion Levitchi, Head of Trademarks and Industrial Design Department of AGEPI. In the presented communication was also proposed that a Guide (Joint Recommendation) on the temporary protection provided to industrial designs at certain international exhibitions be developed within the SCT. The topic of geographical indications was discussed during the Information Session, which was held on 24 November 2020.
