AGEPI under Development of Regulations in the Field of Copyright and Related Rights

On 01.01.2011 entered into force Law no. 139 of 02.07.2010 on Copyright and Related Rights, published in the Official Gazette no. 191-193 of 01.10.2010. According to the provisions of the new law, will be developed and approved by the Government the Regulations on Registration of Objects Protected by Copyright and Related Rights, the Regulations on the Mediation Commission and Regulations on Collective Administration of Economic and Related Rights, and will be reviewed royalty rates for authors and right owners, currently being applicable the minimum rates approved by Government Decision no. 641 of 12.07.2001.

In this context, on 12.01.2011 at the AGEPI was held a working meeting with the participation of representatives of the collective administration organizations - Association “Copyright and Related Rights” (AsDAC), National Association “Copyright” (ANCO) and the Union of Producers of Phonograms and Videograms of the Republic of Moldova (UPPVM).

The parties have supported proposals to initiate the development of the Regulations on Collective Administration and to set the royalty rates for the exploitation of objects of copyright and related rights. Discussions focused on how to set the rates depending on the forms of use and criteria of delimitation. Discussions on this theme continued also at the meeting of 24.01.2011, wherein within which was agreed that representatives of collective administration organizations come up with concrete proposals about how to determine the rates for each type of use of the objects of copyright and related rights.

At the same time, AGEPI considered it desirable to invite in the working sessions representatives of authors/right owners, users and other people interested in these subjects.
